1. Agreement to Terms

By accessing or using ResumeXrays ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

ResumeXrays is operated by ResumeXrays LLC ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

ResumeXrays provides AI-powered resume analysis tools that help users understand how their resumes are parsed by applicant tracking systems (ATS). Our Service includes:

• Resume parsing and ATS compatibility analysis
• AI-powered content suggestions and improvements
• Resume storage and management features
• PDF report generation

We do not guarantee that our analysis will result in job offers or interviews. Our Service provides recommendations based on industry best practices, but hiring decisions are ultimately made by employers.

3. Account Registration

To access certain features, you must create an account using Google OAuth or another supported authentication method. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Acceptable Use

You agree not to use the Service to:

• Upload content that violates any law or infringes on third-party rights
• Attempt to reverse engineer, decompile, or access our source code
• Interfere with or disrupt the Service or its infrastructure
• Use automated systems to access the Service without permission
• Create multiple accounts to abuse free tier limits
• Share your account credentials with others
• Upload malicious files or content

5. Payment Terms

Subscriptions: Pro subscriptions are billed monthly or annually in advance. Your subscription will automatically renew unless cancelled before the renewal date.

Credit Packs: One-time credit purchases never expire and are non-refundable once used.

Refunds: We offer a 7-day refund policy for new Pro subscriptions. Contact us at help@resumexrays.com within 7 days of your first subscription payment to request a full refund. After 7 days, refunds are provided at our discretion.

Cancellation: You may cancel your subscription at any time through your account settings or the Stripe customer portal. You will retain access to Pro features until the end of your current billing period.

6. Intellectual Property

Your Content: You retain all rights to the resumes and documents you upload. By uploading content, you grant us a limited license to process, analyze, and store your content solely for the purpose of providing the Service.

Our Content: The Service, including its design, features, and analysis algorithms, is protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and resume data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEES ABOUT THE ACCURACY OF OUR ANALYSIS OR ITS EFFECTIVENESS IN HELPING YOU OBTAIN EMPLOYMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR EMPLOYMENT OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our data retention policies outlined in our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
